Introduction There is no definition of Tender in the
contract Act. Moreover, agreements and contracts have been separated
in the contract Act. Section 38 of the contract act muse be referred
to understand the definition of Tender. Its title is “Results of
rejection of proposal of contract”. Tender can be design from it as
deed of proposal of making contract. Thus, promises doesn’t accept
the responsibility of contract only by proposing contract. Promise is not bound to oblige the proposed contract until the
promisee accepts the proposal. Rights and duties under the contrast arise
only after the contract comes in to existence.
Different forms of Tender Forms
Tender forms of construction, material and transportation being
used by public works Department, Roads and Building Department,
Irrigation Department of Gujarat State Government by keeping in view
the different classification of contracts in public sector, are as
under:
- Requisition Form (For purchase of miscellaneous material).
- Rate list (For labour or construction items upto Rs. 5000/-).
- A-1/A-2 Agreement of miscellaneous works. (Upto works worth Rs.
50,000).
- B-1 Percentage Rate Tender.
- B-2 Item Rate Tender.
- Two cover/Three cover bid system Tender.
- Lump sum agreement (Lump sum Tender Form-C) New Turn Key
agreement.
- Tender-D for purchase of material.
- Percentage Rate Tender E-1 for Transport.
- Item Rate Tender E-2 for Transport.
- L.C.B. or N.C.B. (Local National Competitive Bid Tenders) .
- International Competitive Bid (ICB Tender).
- FIDIC (Global Form).
- Recently Roads and Building Department has started asking for
Build Operate and Transfer Tenders.
- Tender form for purchase of material by central store Purchase
Officer cum Commissioner of Industries.
Tender Notice
Advertisement of Tenders demanded for the work of above Rs.
5000/- is published in Newspapers.
Standard of in how many news papers should the tender notice be
published is as under :

Tender notice is deem published from the date on which it is
dispatched from the office for publication.
Tender notice can not be declared in any case before the
approval of D.T.P. (Gujarat P.W. Manual Section 200 II) |
